Compli-Serve Legal Services (Pty) Ltd offers a Complaints Advisory and Resolution Service in respect of complaints received by Financial Service Providers Financial Advisory & Intermediary Services Act 2002 “FAIS”.

Introduction

It is expected that the FAIS Act will result in an increased number of complaints from consumers .Some of these complaints will be justified however many will not.

It is important that the Financial Services Provider “ FSP” is advised as to the merits of a complaint as quickly as possible in order to both ensure compliance with the rules and associated time frames laid out in the regulations of FAIS and keep business interruption to a minimum.

Compli-Serve Legal is able to offer a professional service whereby experienced compliance and legal professionals are able to advise and support the FSP in evaluating the merits of the complaint and to assist with a resolution process.

Deliverables include:

  • A professional evaluation of the complaint.
  • Guidance as to the appropriate course of action
  • Drafting of responses for presentation to the Office of the FAIS Ombud
  • Liaison with the Ombud and the FSB as required

Service Charges

The initial evaluation of the complaint is undertaken at a fixed fee. The FSP may then elect to proceed with Compli-Serve or utilise their existing legal representation to bring the matters to a satisfactory conclusion.

Where Compli-Serve are to appointed to proceed with the complaint resolution process fees are billed on a time and material basis. Prevailing rates are available on request.
